Technically the characters that appeared in the show are considered separate from comic originals so they weren't subject to the same work for hire contracts - Sally, Ixis Nagus, Bunny, Dulcy, and all those should be allowed. They were able to appear in the post-Genesis Wave continuity for that reason. But Sega wants them buried to prevent any further legal trouble, and they have the IDW characters on lockdown from creation so they can use them freely if they choose.
