It's all marketing: the clearest way to convey Andrew Garfield's SpiderMan is to package him with logos and titles from the movie he came out in.
Same way those X:TAS figures get those X:TAS packages instead of the generic Marvel Legends packaging. Or saying their boxes are totally more eco-friendly to please the faggot crowd.
Again, likeness rights have been included with the movie licenses for longer than you've been alive. I don't think there's any actor who is able to get the pull NOT to have their likeness included anymore. Even fucking Sigourney Weaver got her Avatar figure, despite her crying about not liking being involved with shit with guns. (for newfags: one of the earlier claims as to why Ripley toys weren't made with her likeness, since that was an 70s film and likeness rights were seperate from movies rights. So a lot of companies were too poor to pay twice just to make a single figure)
