The importer is responsible for following the import laws of the country they live in.

You would have to import an absurd value amount in one go, or some very specific items, in order to invoke customs fees in the US as an individual. The China/Mexico tariff conversations are likely going to have an effect on this in the coming years, but it remains to be seen what the implementation will actually be.
