GT operates out of China so they're basically untouchable on copyright claims but if HasTak has somebody within legal reach like a Japanese fan artist, they could easily take him down.
Worse yet is that these designs have been floating around for quite a while now and HasTak HAS to know they exist by now. If HasTak catches wind of the figures, their lawyers could come knocking on the guy's door anyway and he'll have to prove that he has no involvement whatsoever with GT and that they just stole his designs.
His best bet might just be to keep his head down and stay out of it, else it could ruin his whole life. He may as well roll with it and just take the flattery that comes with knowing somebody was willing to make figures out of his work because you know damn well HasTak never would have, especially not at this level of quality because it's not worth getting into a legal battle that he will most certainly lose.
That being said, I'm a shitty person and will most likely be buying the figures anyway because I've been dreaming of seeing those designs get toys. I know the moral thing would be to boycott them and not support such behavior but those figures are too fucking amazing to pass up.
