With DC, Mattel has the license to produce and sell toys to walmart, targets, TRUs, while DC Collectibles has the rights to sell them to comic stores and other specialty shops.
So however NECA got the license, it had to be really specific in the language of where they could sell it. It's like how the TMNT line was only able to be sold for the comic conventions in San Diego and New York, even though Playmates has the TMNT toy rights for mass market stores and collector stores.
