Impactor as a miner, like on this toy, is from IDW 1.0. At that point, he was a friend of Megatron, but this is prior to Decepticons existing as a faction. While he was a bit of a rogue element in that, as far as I know, he never wore the Decepticon badge in that series ever.
Most people assume the only reason he's a Decpticon here is because each of the fan vote options was an Autobot-versus-Decpticon two-pack. So they made him a Decpticon to fit the theme.
Ironically enough, if Impactor turns up in the new comics, he'll probably be a Decepticon (at least at first) because this new series draws so specifically from the Siege toyline (or is forced to draw from it, who really knows).
