With what has come out today, marking a video/channel as "not for children" means jack shit as the FTC will determine content as for children if it falls under certain vague categories. That means toys, video games, "animation", etc. It's going to fuck a lot of people and it may just kill Youtube totally. Pewdiepie's going to have to get a real job.
"Move elsewhere?" That's not an option as this is US law, not Youtube policy. And while I can see them being unable to fine anyone outside the US, the website owners can also be sued for the content. This own't even end at videos, BTW- I expect deviantART,
fanfiction.net and other such sites will have to close, because that rule 34 drawing or "erotic fanfic" could be deemed as "for children" base don the franchise alone as the old white people who cooked this up see all animation as "child-oriented", they always have. That means Simpsons & South Park could also end if the FTC determines they may appeal to kids.
Companies probably love this. Hasbro gets to kill off 3P reviews & discussion without lofting a finger. They don't need TPP to kill negative product reviews, just claim your bad review in a "for children" category violates COPPA if you curse or act too harsh. Companies end unauthorized fan productions.
The FTC will use this to make money and control people. No government that pushed to have a man who raped teenagers into the supreme court cares about child safety, and I bet none of the candidates for 2020 will oppose this, not even democrats.
