He wasn't at the very, very top of the entire Foot Clan, but he was still the leader of the New York branch, and by the time he had his branch in full swing the Japanese side wasn't really checking in on him anymore (which leads to issues later on and is also why Karai eventually has to get involved).

Lore-wise, they have never brought back the Shredder, and when "Shredder returned", it was actually a clone (the actual Shredder died in issue 1 and forever stayed dead). Functionally, though, it was the Shredder in every way, and he gave the Turtles a really hard time now that he was back and even drove them out into hiding in April's farm (all the stuff with clone Shredder was actually adapted into the movie, except there it obviously was the real Shredder). The clone Shredder, just like the original, was killed as well, though his body was burned to make sure no more clones could be made.
