-The more promotion Magic Henshin got, the less we saw the G1 Nicee head. It was ultimately dropped late in production after the raids against KO companies, indicating BFB wanted no chance Hasbro could target them.
-BFB got Japanese retailers to carry their original stuff, reaching a wider range than just the 3P transformer market. At that point, it's just a better look to do original design stuff.
-They're not reissuing Nicee despite her popularity, indicating that her vehicle mode and colors are still too Arcee for comfort.
-They're redesigning EX-02.
Conclusion: while BFB was ok with doing not-transformers early on, when it seemed the easier way to get their stuff attention, it's now probably too much of a PR/legal risk to be what they want to do now.
