Batman himself to sell. And toy companies were mainly going to focus on the most popular seen iterations; i.e. the movies and animation. So when the 89 Batman movie came out, Toy Biz was stuck with only being able to make a figure of Batman, the Joker, and Bob the Goon.
Then before Batman Returns, Kenner bought the Batman franchise. Kenner wanted to make more Batman figures with gadgets, and came up with the idea to make him different colors to justify it. However, Kenner couldn't make Batman in colors unlike the source material...until film producer Michael Uslan told them that in the 50's Batman had different colored costumes in this comic. Which created a legal loophole Kenner ran with. This was a total gamechanger and influenced kid's superhero toys to this day
