It's not because they don't want to be sued, it's because they don't want to spread potential misinformation by relying on "presumptuous information", I.E. context gleamed but hasn't been openly confirmed from Nintendo, TPC, GameFreak, Creatures or any other official Pokemon source.
Even the most innocuous of things that SHOULDN'T be an issue follow this process of "don't present presumptuous information as hard fact."

You need to remember that Bulbapedia doesn't like being 100% certain on something unless GameFreak or The Pokemon Company outright states it.
Unless it's related to a Pokemon's gender in the anime, in which case anything goes in order to support the shippers that have made a community within the Bulbapedia name.
