Well since the X cart now has the newest patch, and the same check system, it will also refuse to trade the new item over to the Y cart and also give it an error with a message saying please update before trading this item.
Oh and so what if you get a new 3ds and play it without the patch, even though you already have the new items? Well the game probably has some kind of fail-safe system that checks for unknown items/pokemon and places them in a placeholder spot for unknown data until the appropriate patch is downloaded. The said items/pokemon will then not be accessible and appear to have vanished from your game until you get the patch.
It's really not that difficult.
