....they could always ban phones using GPS spoofing programs in the background checking every 5 minutes just once natively on the machine to make sure they're not cheating, but that wouldn't be easy so they don't do it.
They seriously are expecting new pokemon to fix the gym imbalances. Niantic is lazy.
