Pretty much every time you fight a wild Pokemon, it's because they came at you and instigated the battle, so beating or catching them is fair game. But fishing is literally just you yanking an unsuspecting Pokemon up out of the water and smacking the nonsense out of it. Even worse is Headbutt trees in Johto, you can fucking jostle a sleeping Hoothoot out of its nest and imprison it before it even wakes up.
