If it's a mythical by gamefreaks standards, its a mythical. It's literally in the games code. What I classify it as means jack shit. The most consistent answer is they sit at the tail (or head in victini's case) end of the dex, can't breed (not counting manaphy, cuz it doesn't make a manaphy) and are banned from online.
Other than that, it's up to the company that makes the games. I could call male combee a legendary, but if it isn't coded as such, it doesn't matter
