Because the game is a game, and the things inside it don't actually exist. New pokemon enter the zeitgeist whether you buy the game or not. You can't actually buy new pokemon. A mega pokemon is different enough to be considered it's own independant concept, as much as most pokemon: For example. Mega Gardevoir is as different from Gardevoir, as Machamp is from Machoke. Mega Mawile is as different and unique compared to Mawile, as Pumpkiboo is compared to Gourgeist.
