It could be something as straightforward as Congress passing a law that prohibits Silph Co. and other Pokeball monopolies from creating balls that capture humans. But here's the thing. If all animals are Pokemon, and humans evolved from animals... well, there you go.
The simplest answer is that this is a children's game that didn't want to address the idea of fucking pokemon and human slavery. The closest thing we'll get to real life in this IP is Slowpoketails and that one OVA in Origins where the police use Growlithes with Fire Blasts instead of breaching charges.
