I had heard that the XL fixed the design flaw of the system scratching itself, but I wasn't totally convinced from the posts on 4chan so I decided to look it up. Turns out that it's on a case to case basis, not all XLs get the dots. Really dumb though. They aren't cheap, you'd think the quality control would be a bit better. Nintendo needs to fix their shit.
If you call and bitch at Nintendo they might be able to replace it for you. I've heard of people getting free replacements because of the screen scratches, so it might be worth trying.
