Also why would you think that Nintendo doesn't already know of showdown? They knew of shitty gbc hack pokemon prism, and that was far less known of than showdown. Nintendo is also trying to get people to jump onto the switch pokemon games. Legal action against fans tends to make you look like an asshole even when you're in the right, and they don't want the bad publicity.
