This in no way stops hacking, and only encourages hacking better, while also punishing users who would have "learned their lesson" and stopped hacking when given the opportunity to release problematic Pokemon to continue using the service. I mean, BDSP sorta does this with cloned Pokemon by locking all Pokemon with the same PID from being traded until only one remains, so where's any of that in Home? It's ridiculous just how little thought seems to go into this kind of thing.
