A good general rule would be if it's capable of using what is recognized as a move and/or has an ability, it's a pokemon. Further clarification can be made based on if a shiny has been discovered of a species. Also, possibly if it can go in a pokeball, but only if pokeballs don't work on humans(depends on if we regard the anime's jelly f- I mean rice ball capture and the like)
A pokemon will know some move from birth and is incapable of having no moves. So that seems like the most consistent measurement. Humans don't know moves.
