If people suddenly stopped using Dialga, it probably wouldn't drop down to NU because it would simply destroy everything there and be too powerful. Also, now that I've started playing NU more frequently and climbed up the ladder, I've seen Jynx EVERYWHERE, and I really mean it, EVERYWHERE. Jynx in NU is as common as Ferrothorn and Scizor combined in OU. There's absolutely no reason for Jynx to be NU if tiers are actually based on usage. The whole upper part of NU ladder is so heavily centralized around Jynx that it's getting ridiculous. If you're not carrying a Jynx "counter" (it hardly has any counters in NU), you should just expect it to Sweet Kiss your lead, boost with Nasty Plot and sweep at least half of your team.
So basically, why would Jynx be NU since:
>it's overused as fuck, nearly everyone runs it>it's centralizes almost the whole tier>it doesn't have any real counterI guess the most logical reason is that Smogon doesn't give a shit about the lower tiers because muh precious OU.
