These are guidelines for external companies making things like figures and quiz books who GameFreak, The Pokemon Company and Nintendo might not have had any previous dealings with and might not trust. Its there to absolve them of responsibility and communicate their expectations. Of course the games, tcg and anime break these rules because they're created by people who have control over the IP and who trust each other not to damage the franchise's reputation. Iwata could order a game to be made where Ash fucks Misty and Misty lays an egg if he wanted to. These are guidelines for people Nintendo, TPC and GF don't know very well and don't trust not to fuck up their reputation.
And if you think they're being over-zealous, I'd like to refer you to the incident in 2013 where google searches for "Pokemon X" where coming up with a "Pokemon XXX" video on xvids and parents went apeshit saying GF shouldn't have called the game "Pokemon X" because children might stumble upon illicit images while searching for it.
