Bullshit inconsistency.
The only argument I can see is that Dusk will eventually be obtainable through normal means, like Zorua and Zoroark who weren't banned from anything in BW1 despite being event-exclusive at the time. Or Phione is banned by proxy of Manaphy like Cosmog and Cosmoem, which is also retarded.
