Consider businesses and taxing for example. There are tons of ways that are perfectly legal to cut your costs and pay less taxes. There are systems in place to allow this. Would people call some of these immoral or unfair? Certainly, but not illegal. This would be analogous to abusing the RNG.
There are however a lot of ways to illegally cheat the system. You can misrepresent your income, and be sneaky about lying. This is analogous to using pokegen. Just because you can get away with it does not make it not cheating or not illegal. It all comes to the question of if you get caught, or if you mess up, will you get penalized for it. If the answer is yes, then it is cheating.
You can never penalized for messing up RNGing, while you can for messing up pokegening. This is what makes it cheating.
