If it does it'll be for anti-piracy measures, although I doubt they'll do it.
However, you have to update to the latest firmware in order to use the eShop, for those who want to download the game.

After each firmware updates, the DSTwo stuff will roll out a new update for the DStwo cart. Just make sure you update your cart before you update the system.
