The only reason the leakers and stores BEFORE the game's release got Nintendo'd was because it was BEFORE the official release, and even then the leakers only got cease and desist letters (which are legally non-binding and have no power in court), while the stores faces the brunt of the penalties, as the law allows Nintendo to do.
The game is already released, it's a free game as to what people do with it, and Nintendo has no legal power, even if they even have quadrillions of dollars thrown at a case, to dictate what people do with their games and consoles once they're in the user's hands.
