The patch could be transferred to other games.
If you locally battled someone with the patch, their game would recognize your game as not being updated, and send the patch over.

FRLG did this with RS. Perfectly doable.

Yes, or the game could just understand the majority of what the opponent's pokemon is like. I mean, you can hack a pokemon to change its ability, moveset and stats and the opponent gets fucked over by that just fine.

Hell they could even do something else if they had to. BW can fight against B2W2 just fine, despite the inclusion of B/W Kyurem. It just shows as regular Kyurem with different moves and stats, right? Could do that for unpatched games with a generic placeholder image or something.
