Mega require a new item to be added to the game and so included into saves and such, that's why we already have Latiosite and Latiasite, so they are already compatible.
New Formes, as in past games, do NOT require a patch (except for a graphic one if they want) to work and do not require any item held item (usually).

That's exactly why PS3 games with DLC made you sign a different user agreement. You probably don't read them, do you?

Then what? You lose the items since the save is not compatible.
Think about this and about the fact that we already have Latiosite and Latiasite in xy EXACTLY FOR COMPATIBILITY REASONS and you'll understand that ORAS won't have any new mega.

The said items/pokemon will then not be accessible and appear to have vanished from your game until you get the patch.
It's really not that difficult.
