No Events or Box Legends allowed.
Phione counts as the former because it could only be obtained by breeding an Event Pokemon. Not everyone is able to get a Phione, so they banned it. BST is irrelevant in this case.

The logic is still flawed. For example, people with White 2 can't get Latios, yet Latios isn't banned. Meanwhile Phione is banned even though it's far easier to reproduce than Latios since it can be mass bred. Same applies to Zorua and Zoroark before BW2 came out (event only), yet they weren't banned.

Latios can be obtained by buying a second game.
Phione requires you to have gotten an event Manaphy in Gen IV. Nobody cares whether or not it can breed.
Zoroark was available in-game in B2W2, you said it yourself, that's why it isn't banned. Also it isn't Legendary.

B2W2 didn't exist when Zoroark was introduced. Nothing was stopping them from banning it at VGC 2011 for being event only. Yet they didn't. There's no good excuse for Phione to be banned.

Zoroark was entirely unavailable through regular gameplay when Black and White first came out, but were still legal in tournaments.
