I'm pretty sure it's because those people are already in battles, and the passersby tab thing doesnt show when people are busy like friends and acquaintances does, which is retarded.

I thought this was a conflict with the game chat settings between two players. I've had it happen once or twice, but then I'm the one that has it automatically disabled.
