still, i THINK it shouldn't be a problem, since ds games can't connect to the internet, and so your 3ds won't be connected to the internet while playing using the r4. also you can't run in the background on the 3ds so no problem here too.
then, let's say youre surfing the net (using the browser) even with the r4 cartridge inserted in the 3ds, how could they possibly know which cartridge you have in the 3ds? also because browser+ds games can't be open at the same time.
finally having an r4 with ROMs saved onto it, it's not illegal, as long as you own the original cartridges (or downloadable version) of said game.
