Any kyogre running Spout needs to outspeed everything it can, because any damage it takes weakens it. Groudon doesn't care about this except the possible Eruption sets now that the move has STAB, so it can run bulk/attack investment and thus will always go second to almost every kyogre.

Considering the other side is just using the most try hard legends they can think of thrown together with the highest BP moves available and little other thought to speak of, I'd let it slide. Especially when you consider those legends don't even have good ivs.
