The patch would add the new mega stones into the item database. You could simply use an "All Items" code to unlock them.
Similar to how it's possible to unlock the gems, mega launcher items, apricorn balls, and Latios/Latiasite.
You'd need the patch installed, but it's nothing like the Mewtwo DLC, which is behind a paywall.

Remakes prevent to creation of new content, reusing the same Region, pokemon, moves, abilities all over again.

The patch data would be stored to the SD and not the cart. The software would be unable to read any and all patch/update data. It has no contact with it, can ony read the save file. Using an all items codes would treat it as just an original unpatched copy of X/Y. You cant insert new data if the software doesnt know what the new data is. It edits your saves, it cant create new data that doesnt originate from the cart or originally exists on it.

Fantasy Life on 3DS is like this, the save file is stored to the SD even if you have the cart. If you tried to edit your save it wouldnt work since the save data doesnt exist on the cart. Thats why you are able to use a single fantasy life cart on multiple systems since the data is stored to the respective users sd cards. If you were to take my copy of fantasy life and play it on your 3ds, my data would not be there since it doesnt exist on the cart.

If new data can be created and inserted why haven't hackers already made their own fake mega evolutions?

Its like mortal kombat or mvc3, you van use dlc figther, but can fight with people who had them.

The real reason we're not getting a content patch is because Nintendo doesn't want people unable to access saves or play the game once they shut off their eshop servers.

If you download such a patch, play the game, you are locked into using that patch. If your SD Card or 3DS breaks, you need a new one, and eShop is closed, you will be unable to use that save file.

On top of that, it may be difficult for them to give you an easy way to delete the save file at all in such a situation.

Oh, okay. This makes more sense. Someone was trying to explain this in some other thread a week or so ago, but failed to mention this part.

Although, now that I think about it, I can still access the eshop on my wii, even though they've discontinued a lot of internet services with the wii and ds. This might only be a problem way down the line.

It will simply give you a message saying "this pokemon is holding an item that can not be traded" when you select the salamencite holding pokemon

Same thing happens if you try to trade something holding a lati megastone.

There's no point in patching, though. People are going to use ORAS - the game where they have access to the new tutors, learnsets, etc - as their main game to keep their team on, they're not going to transfer shit from ORAS back to XY and use that as their main.
