Games and saves are tied to the device itself. While you can recover your games with your Nintendo ID, your saves are only ever compatible with the device they originated from. It's only ever possible to move data from one 3DS to another via the transfer application on the device.
If for whatever reason something goes awry with your 3DS, you're absolutely fucked. Would you rather lose one game's save or a two dozen?
And no, I've never managed to lose or break a handheld, but this shit doesn't sit right with me because properly backing up and maintaining data is an important part of my career.
