Deoxys is in "tier purgatory". It's useless because Deoxys-A completely outclasses it in every way. Same movepool, effectively the same level of frailty (technically less, but it's at such a low level as Normal that lowering it further causes no significant changes whatsoever), but better offenses. However, Deoxys-N is still far too strong for OU. It can't go there without wrecking havoc, but is outclassed in its proper tier. Thus, it's forever considered useless.
Secondly, to address your first post, items matter. A lot. In fact, the offensive stat is the least important stat of all, as multipliers are way more telling of a Pokemon's general ability. M-Lucario has lower stats than M-Alakazam, but outdamages it by a significant margin due to access to boosting moves and Adaptability. Likewise, LO Lucario actually outdamages M-Lucario in non-Adaptability boosted moves, despite a huge gap between their offensive stats.
So the ability to hold an item is the most important factor here. A better movepool and the ability to go mixed on Deoxys' part helps a lot as well, though.
I assume this question is leading to this: "Why not just ban the ability to use items on Deoxys-N, thus allowing it OU status?" The reason for this is because it's a complex bans. Complex bans are dangerous because they're a slippery slope-- you can pose this question for nearly everything.
"Mewtwo's way too strong for OU, but if we ban all moves over 60 BP on it, it's much more manageable in OU!"
Take it a step further
"Terrakions way too strong for NU, but without an item and only Rock Throw and Karate Chop, it's much easier to deal with!"
In other words, not allowing complex bans sets a limit and a standard on what should be allowed to be banned. Ban the entirety of it or not at all.
