It's relevant that it's an outfit based on a Pokemon, as opposed to just being a Pokemon, and it's also relevant that Nintendo is very unlikely to start selling Pokemon costumes on Gaia Online themselves soon, so it's not eating into a potential market for the copyright holder. And it's not like anybody will think "now that I have a Pokemon costume in Gaia, I have no need to buy Pokemon games anymore!"
Nintendo COULD claim copyright infringement here, but I think they'd lose.
