Except that already happened, and they got zero shit for it.

There's a fakemon floating around that a lot of people "loved" for some reason, that was a panda Pokemon. It had bamboo on it, so it was part grass or something.

Gamefreak then comes out with Pangoro, and everyone loves him, but no one says anything about the fakemon being first.

GameFreak using the same animal for a real Pokemon does not equate to GameFreak ripping off the design. Especially since Pangoro's concept (bancho panda) is completely different from the fakemon (panda with bamboo on it).
