It's a notification for you to stop all actions on the thing you're working on or else there will be legal actions taken. It's the equivalent of a first and final warning. A company cannot stop you from talking about a cease and desist in any way, shape, or form and you can't be legally punished for announcing one. You can't include a C&D in an NDA either, the only way to stop someone from talking about a C&D is through a gentleman's agreement to keep things private.
Second of all, what you're claiming makes no sense. Why would a company pursue further actions for revealing a letter that announces further actions will be taken, if the devs are willing to comply with the C&D in the first place? It's blackmail and would not look good for Nintendo if it were brought to court.
The most likely scenario is that they realized they don't want to keep on working on Project M and want to move on.
