If a government were to acknowledge it as a thing, they'd probably make you give up training but they'd also have some kind of failsafe prevent catching a pokemon that obviously isn't wild. Like a government database of pokemon that the balls won't capture, or some kind of paperwork and some bracelet they wear. I don't know. It just wouldn't make sense for them to think far enough to deal with the ethical issue of owning your spouse and not remember to account for someone deciding to catch them.
Smart pokemon like Lucario, Gardevoir, Gengar, Alakazam, and even Porygon Z would probably have some legal rights especially if they've been processed and can fill out some basic paperwork. Maybe even without it. We do the same with Chimps and Dolphins, and call them non-human persons. They'd definitely do the same for beings of human intellect or even just near-human intellect.
