If you are on an old 3DS then you should 'Initialize savedata' before trying each time (delete the cookies and history).
Also, since 10.4 was released, an old 3DS will fail at the orange screen far more frequently than before, so if you ever do get it to work, then make sure to install MenuHax or OoT/Ninja-Hax.
