I don't think I've ever heard of someone getting banned from Pokebank, it just won't go through. There's not much risk, if any.

just make sure you're not connected to the internet while you transfer your pokemon and the legality checker won't even work

You won't get banned it just won't go through. I injected all 720 Pokemon into my game and transferred them into poké bank with zero issues.
