If someone wants to be an idiot and get hit crossing the road or drown by going in the water for a pokemon, that's their fault. Driving distracted on the other hand puts everyone on the road at risk. And I don't care how good a driver you think you are, there's studies proving texting and driving impairs you as much as or more than drunk driving.
