How are people selling fanart of pokémon and products like shirts, posters, etc without getting sued? When do they draw the line between fan art on shirts, cosplay photo prints, and shit that has been sued like the bulbasaur Chia pet and that one guys pokémon party using official pokémon pictures.

Since I guess it's relevant, after I asked TeeSpring why it had been taken down, they forwarded me this e-mail sent by TPCi's legal counsel to their website. So yeah, they are really, really cracking down. It's probably because of the popularity of Pokemon GO - I know I was personally trying to profit off of it.

I suppose it's a little touch and go, but there are ways around this; as long as you aren't using copyright artwork(like logos and characters ripped right out of the source), and names. "Pikachu hoodie" becomes "yellow eared hoodie" or something along the lines of that. It's how knock-offs usually make it to market. I remember a company like Funimation kind of poked at fanartists on DeviantArt telling them they endorsed fanart and commissioning it, so long as they didn't market it as "trade marked name art". So you just market it as "art".

When it concerns the internet, it's a lot more iffy because the laws are outdated.

What image was being used on this shirt? Seems like they pissed TPCI off severely and a simple cease and desist wasn't enough.
