Going deeper, it doesn't only need that but also needs the "seed", which is also only obtainable when the game gets officially released on the eShop. So even if they were to make preloading and we'd obtain the titlekey with that, it'd still lead nowhere.
So basically, the ONLY way to play it early is to hope for a physical leak (reviewer/store release break or whatever) to dump a cartridge and upload online. Which will probably happen, even if just a week before the official release.
