Yeah, they tend to still include games. I think it's because the 2DS is the budget line and including a full game really increases the value for the budget-minded set.

Hopefully someone else can chime in because I'm not entirely sure, but it's because pre-installed games aren't as secure or something like that. The .cia dump you can make with one of them can be run on a non-cfw console.

That's true. You can install those games because they're not tied to an eShop account. I don't think that's the reasoning behind not making special editions include the game, though. If that was, there wouldn't be a 2DS bundle at all.
