Idealy and most likely next week, before the 9th. People have many more ways of obtaining illegal copies and CFW is nearly active on all buy one firmware version, not to mention that Citra is in a semi-stable state as well.
XY leaked about a week and a half before release, but CFW didn't exist and Gateway was in its infancy stages at that time so no one really cared about grabbing a copy except for Canadians. ORAS leaked 4 days before, but CFW was only in its infancy stages adn there were only like two ways to actually rip a cart to a PC, so once again people leaked.
Pokemon has to ship at least 10 million worldwide now so copies will be on boats and planes starting November 4th at the earliest
