Nobody knows. Some say it's a punishment for Italy breaking street date with XY but Canada did the same thing, others think it's about the multiple languages but I think the NTSC also has the German and Italian languages.

Even having the wifi switched on is fine. Just don't access the plaza. The 3DS stays in ad-hoc mode until you try to connect to anything specifically. I used local features and I'm not banned.
