If it's physical then you should be fine since review copies were physical. The people who got banned used the digital version- which was never sent our officially by nintendo. But just in case I'd wait until the game is officially out anyways

Depends how where you live in relation to the delivery routes.
Many online stores send out their games one-two days before release, so if you're an early stop you might get the game a day early.
