You can't use it doesn't mean it's OU. For a Pokémon to be OU it, by definition, needs 3.41% usage in OU tier, which Staraptor never reached.

It's UU by definition. You can't use it in UU, but that doesn't mean it's OU. It's BL.

A pokemon is defined by the tier it has its usage in. However, staraptor can't be used in anything below OU. Thus, all his usage comes from OU

It is OU by technicality, since it is banned from UU and sees no usage in UU.

Also, it's BL by definition, not UU.
